Our Services include but are not limited to automated customer support, outbound communication (calls, texts), scheduling assistance, and other AI-driven tools for business efficiency.

2. Acceptable Use

By using our Services, you agree to the following:

You will not use the Services for unlawful, fraudulent, or malicious activities, including sending unsolicited communications, promoting scams, or violating privacy right. You will comply with all applicable local, state, and federal laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) and the rules and regulations enforced by the Federal Communications Commission (FCC).You are solely responsible for the content, data, and communications sent through our Services, including any outbound calls or text messages.

3. Compliance with FCC and 10DLC Regulations

Insane Agent adheres to all relevant communications regulations, including those set forth by the Federal Communications Commission (FCC) and the 10-digit long code (10DLC) rules. As such, you agree to comply with the following:

Outbound Calls & Texts: All outbound communications (calls or texts) made through our Services must comply with the Telephone Consumer Protection Act (TCPA), including obtaining consent from recipients before sending automated messages, robocalls, or text messages.10DLC Registration: If you use our Services for text messaging, you must ensure that your phone number (or other numbers) used for messaging is registered with the appropriate carriers for 10DLC compliance. This helps to ensure your messages are properly delivered and not flagged as spam or violating carrier policies. Opt-In & Opt-Out: You must obtain express, informed consent from recipients before sending any text messages or making automated calls. You must also provide an easy way for recipients to opt-out of future communications (e.g., reply "STOP" to unsubscribe).Monitoring and Enforcement: We reserve the right to monitor and review all communications sent through our Services to ensure compliance with the FCC, TCPA, and 10DLC regulations. If we detect any violations, we may suspend or terminate your access to our Services.

4. Account Creation and Security

To use our Services, you may be required to create an account. You agree to:

To the fullest extent permitted by law, Insane Agent, its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use our Services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from this Agreement will not exceed the amount you paid for the Services in the six (6) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Insane Agent and its affiliates from any and all claims, liabilities, damages, and expenses (including reasonable attorney’s fees) arising from your use of the Services, your violation of this Agreement, or your violation of any laws, including those related to outbound communications or data privacy.

11. Changes to Terms and Conditions

We reserve the right to modify or update these Terms and Conditions at any time. If we make significant changes to these Terms, we will notify you through the email address provided or by posting a notice on our website. By continuing to use our Services after the effective date of any changes, you agree to the modified Terms.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the state in which Insane Agent is headquartered, without regard to its conflict of law principles. Any disputes arising from this Agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
